Charges Filed in July 2012 Cattle Shooting

Dillon Gappert of Hensler, N.D., is in custody following criminal mischief charges filed in South Central District Court last week, according to Oliver County State's Attorney John Mahoney.

 

The charges stem from a cattle shooting incident on or about July 4, 2012, near mile markers 13 and 14 off Highway 25 in Oliver County, N.D. Nine head of cattle – four cows, four calves and one yearling – owned by John Dixon and Miles Tomac were killed. The animals had a value of at least $12,000.

 

Under North Dakota Century Code 12.1-21-05, criminal mischief carries a class B felony penalty if the actor intentionally causes pecuniary loss in excess of $10,000.

 

The investigation was handled jointly by the North Dakota Stockmen's Association, North Dakota Bureau of Criminal Investigation and the Oliver County Sheriff's Department.

 

Gappert's preliminary hearing will be scheduled at a later date.
