Supreme Court To Hear RR Alfalfa Case

The future of Monsanto’s Roundup Ready alfalfa seed will be considered April 27, 2010 when the U.S. Supreme Court hears oral arguments in an appeal that challenges a lower court injunction against its sale or planting.

In 2005, USDA’s Animal and Plant Health Inspection Service ruled the Monsanto seed did not present a risk to plants. The biotech product hit the market that same year.

Monsanto’s senior vice president and senior counsel David Snively says similar cases hav previously been struck down.

An interesting twist to the case is that Justice Stephen Breyer will not participate in this case as his brother was the lower court trial judge.
